Tesla Inc. has reached a settlement just before its highly anticipated trial over a crash involving its Autopilot system, a driver-assistance feature touted by Elon Musk as integral to the company’s self-driving car ambitions.

Details of the settlement were not disclosed in court filings released Monday in San Jose, California.

The case cantered around Walter Huang, a 38-year-old Apple Inc. engineer who tragically lost his life in 2018 when his Tesla Model X veered off the highway and collided with a roadside barrier at approximately 114 kilometres per hour.

The National Transportation Safety Board’s investigation into the accident revealed that Huang was likely distracted by a video game app on his phone at the time of the crash, while also highlighting “limitations” with Tesla’s Autopilot system.

Although Tesla had prevailed in two previous trials in California, where juries attributed the accidents, one fatal and one non-fatal, to driver error rather than the company’s technology, this trial promised to be its most high-profile yet.

Each trial, including upcoming ones in California and Florida, has challenged Musk’s assertion that Teslas are the safest cars ever produced.

Bryant Walker Smith who is a law professor at the University of South Carolina and an expert in automated driving, noted the significance of the settlement, stating, “It doesn’t guarantee future outcomes but it does tell the story of a company that is not publicly invincible.”

While settlements on the eve of trial are not uncommon, Smith found it surprising that Tesla opted to settle this particular case, suggesting that both sides likely weighed their chances and Tesla concluded that a public settlement was preferable to the risks of a courtroom defeat.

The trial would have featured testimony from several current and former Tesla engineers, offering insights into the company’s development and implementation of its Autopilot system.

The settlement comes amidst Musk’s promise to unveil Tesla’s robotaxi on August 8, a milestone that underscores the company’s focus on artificial intelligence and autonomous driving.

As Tesla continues to expand its reach and technology, it faces heightened regulatory scrutiny over the safety of Autopilot and its Full Self-Driving software.

Despite Tesla’s assertion that Autopilot is an advanced driver assistance system requiring active driver supervision, critics argue that the system may not adequately guard against misuse.

Musk, known for his aggressive approach to litigation, has positioned Tesla to vigorously defend itself in court, including the establishment of a dedicated litigation department in 2022.

In addition to claims against Tesla, the Huang family also alleged that California’s transportation department shared responsibility for the crash by failing to repair the damaged roadside barrier.
